1. Introduction and Acceptance

Welcome to TaskFixer AI. These Terms of Service ("Terms") are a legal agreement between you and Creative Transformations Consulting ("Company," "we," "us," or "our") governing your use of the TaskFixer AI platform, website, and services located at https://taskfixer.ai (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a school, district, or organization, you represent that you have the authority to bind that entity to these Terms.

TaskFixer AI is an educational technology platform that helps teachers create rigorous, AI resistant lesson plans, assessments, rubrics, and student materials. The Service also provides tools for grading student work and generating feedback for students and parents.

The Service is designed for use by educators and educational professionals. It is not intended for direct use by students.

3. Eligibility

To use the Service, you must:

Be at least 18 years of age
Be an educator, educational professional, or authorized representative of an educational institution
Have the legal capacity to enter into a binding agreement
Provide accurate and complete registration information

4. Account Registration and Security

To access certain features of the Service, you must create an account. When you create an account, you agree to:

5. Subscription and Payment

If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period. After that, your access to paid features will end. Your content will remain stored for 30 days after cancellation, during which time you may export your data. After 30 days, your content may be deleted.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Upload or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable

Interfere with or disrupt the Service or servers or networks connected to the Service
Attempt to gain unauthorized access to any part of the Service or any systems or networks connected to the Service
Use any automated means to access the Service or collect information from the Service
Reverse engineer, decompile, or disassemble any part of the Service
Share your account credentials with others or allow others to access your account
Resell, redistribute, or sublicense the Service without our written permission

7. Intellectual Property Rights

TaskFixer AI is a trademark of Creative Transformations Consulting. You may not use our trademarks without our prior written permission.

By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

7.3 AI Generated Content

Content generated by TaskFixer AI based on your inputs is provided for your use in your educational activities. You may use, modify, and distribute AI generated content in your classroom and educational setting. However, you may not resell AI generated content as a standalone product or claim it as entirely your own original creation for purposes of professional publication.

7.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without any obligation to you.

8. Student Data and Privacy

If you upload student work or student information to the Service, you are responsible for ensuring that you have the appropriate consent and authority to do so under applicable laws, including FERPA and COPPA.

We strongly recommend that you remove student names and other personally identifiable information before uploading student work. Use initials, ID numbers, or other non-identifying codes instead.

Our handling of student data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our Privacy Policy.

9. Disclaimers

9.1 Service Provided "As Is"

TaskFixer AI uses artificial intelligence to generate content. While we strive for accuracy and quality, AI generated content may contain errors, inaccuracies, or content that does not meet your specific needs. You are responsible for reviewing all AI generated content before using it in your classroom or sharing it with students, parents, or others. We do not guarantee that AI generated content will be accurate, complete, appropriate, or free from bias.

9.3 Educational Decisions

The Service is a tool to assist educators. It is not a substitute for professional judgment. You are solely responsible for all educational decisions, including curriculum choices, grading decisions, and communications with students and parents. We are not responsible for any educational outcomes resulting from your use of the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CREATIVE TRANSFORMATIONS CONSULTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Creative Transformations Consulting and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

12. Termination

You may terminate your account at any time by canceling your subscription and deleting your account through your account settings or by contacting us.

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent or illegal activity, or extended periods of inactivity.

Upon termination, your right to use the Service will immediately cease. You may request a copy of Your Content for up to 30 days after termination. After 30 days, we may delete Your Content and have no obligation to retain it.
